{"id":9573,"date":"2021-11-25T05:00:51","date_gmt":"2021-11-25T10:00:51","guid":{"rendered":"https:\/\/jolt.richmond.edu\/?p=9573"},"modified":"2021-11-11T09:31:47","modified_gmt":"2021-11-11T14:31:47","slug":"legal-issues-ripe-for-picking-with-shift-to-the-metaverse","status":"publish","type":"post","link":"https:\/\/blog.richmond.edu\/jolt\/2021\/11\/25\/legal-issues-ripe-for-picking-with-shift-to-the-metaverse\/","title":{"rendered":"Legal Issues Ripe for Picking with Shift to the Metaverse"},"content":{"rendered":"<p>By Michaela Fuller<\/p>\n<p>&nbsp;<\/p>\n<p>The company formerly known as Facebook announced last month that it has rebranded as \u201cMeta\u201d\u2014a shorthand representative of the company\u2019s venture into the still-developing virtual reality world called the Metaverse.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> The company isn\u2019t the first big brand to dip their toes into the VR game, but Facebook\u2019s switch to Meta signifies to many that a big change in our digital society is approaching quicker than once thought, leaving other companies rushing to get an early in.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p>Put simply, Metaverse is a term that describes \u201cthe concept of a future iteration of the internet, made up of shared, 3D virtual spaces linked into a perceived virtual universe.\u201d<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> Described as the \u201cultimate culmination of virtual reality and augmented reality,\u201d<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> the Metaverse is our society\u2019s actual advancement toward science fiction worlds like those from <em>Ready Player One<\/em>,<em> Tron<\/em>, or even <em>The Matrix<\/em>.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/p>\n<p>Meta pronounced its vision for the Metaverse as \u201ca hybrid of today\u2019s online social experiences, sometimes expanded into three dimensions or projected into the physical world.\u201d<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> The company claims its mission is \u201cto bring the metaverse to life and help people connect, find communities and grow businesses.\u201d<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> Yet however simple the goal may be, the legal implications embedded in the journey to the Metaverse are as enumerable as they are complex.<\/p>\n<p>To many, one of the most glaring issues presented by the creation of Meta as a company is a question of antitrust policy. First Facebook acquires Instagram, WhatsApp, and several other smaller companies, and now Facebook establishes itself as a subsidiary of the new company Meta. Such \u201ccompany-shopping\u201d has been warned against by the Federal Trade Commission, <a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a> yet the creation of the entirely new digital world that is the Metaverse will likely open the doors for other companies to follow in Meta\u2019s footsteps in order to get a piece of the (what predicts to be a very profitable<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a>) pie.<\/p>\n<p>Of course, topics like data protection and user privacy are key issues to be discussed and regulated with the creation of any new technology, and the Metaverse is certainly no exception.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> Such an unprecedented development is \u201cpractically begging to become a staging ground for data privacy attacks\u201d that companies like Meta will have to be able to protect its users against before expecting a successful launch.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p>The individualized structure of the Metaverse itself will eventually bring its own set of legal challenges, now likely excited by the creation of Meta. These issues include the \u201ccollaboration and interoperability among different metaverse creators,\u201d and technology usage rights and agreements between companies in the Metaverse.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> Of course, these issues will depend on how companies like Meta will choose to develop the virtual world and its accompanying real-world devices.<\/p>\n<p>The shift to the Metaverse will also bring a slew of intellectual property challenges like \u201cmonitoring use of a brand\u2019s trademarks, misappropriation of goods or services, price erosion, and counterfeit goods,\u201d to name a few.<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a> The question of authorship with respect to copyright ownership may be also challenged in the Metaverse with the possibility of AI and entirely virtual creators.<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a> Issues of brand protection and ownership interests in an entirely virtual world are novel ideas under our current IP regime and are likely going to have to be subject to equally new regulation.<\/p>\n<p>Though the journey to the Metaverse is coming to head quicker than one might have imagined, we still have a way to go (five to ten years, accordingly to Meta CEO Mark Zuckerberg<a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a>) before reaching a <em>Ready Player One<\/em>-style society.
