{"id":8140,"date":"2019-09-30T22:45:47","date_gmt":"2019-10-01T02:45:47","guid":{"rendered":"https:\/\/jolt.richmond.edu\/?p=8140"},"modified":"2019-09-29T22:51:28","modified_gmt":"2019-09-30T02:51:28","slug":"lack-of-federal-regulations-as-the-deployment-of-facial-recognition-technology-increases-results-in-drastic-measures","status":"publish","type":"post","link":"https:\/\/blog.richmond.edu\/jolt\/2019\/09\/30\/lack-of-federal-regulations-as-the-deployment-of-facial-recognition-technology-increases-results-in-drastic-measures\/","title":{"rendered":"Lack of Federal Regulations as the Deployment of Facial Recognition Technology Increases Results in Drastic Measures."},"content":{"rendered":"<p>By: Matt Romano<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/newsroom.cisco.com\/documents\/10157\/14740\/facial-recognition-feature_1200x675_hero_090418.jpg\/eba19a1c-4b85-413d-a1fc-2590fcd7e1ee?t=1535745284920\" alt=\"Image result for facial recognition\" \/><\/p>\n<p>Image Source:\u00a0https:\/\/newsroom.cisco.com\/feature-content?type=webcontent&amp;articleId=1938827<\/p>\n<p>Huge opportunities in the facial recognition industry has led tech giants like Amazon, Google, and Microsoft to develop their own facial recognition software.\u00a0 These companies are now selling this software to law enforcement and government agencies without any federal regulations on the technology.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>\u00a0 Law enforcement all over the country are using this technology in criminal investigations by either running a photo through a database of faces or conducting a real- or near real-time analysis of video footage.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a>\u00a0 The concerns with these practices come from the fact that these facial recognition databases contain more than just mugshots.\u00a0 In 2016, a Georgetown Law study found that law enforcement\u2019s use of facial recognition was affecting nearly half of all American adults.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>Earlier this year, the House of Representatives showed bipartisan concern for the technology\u2019s potential violations of civil rights and privacy at a series of hearings, but no legislation is close to being passed at this time.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> \u00a0Without any federal regulations, some states have left the use of this technology by law enforcement vastly unregulated.\u00a0 In 2016, Georgetown Law found Florida was permitting law enforcement to review a database of millions of driver\u2019s licenses without even requiring reasonable suspicion.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> \u00a0Moreover, eight thousand searches a month were being conducted within this database without the process being audited for misuse.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> Along with concerns about privacy rights, several studies have shown evidence of racial and gender biases within the software algorithms.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> These biases have drawn concerns that people of color are more likely to be misidentified in investigations, which could lead to wrongful convictions. As a response to these concerns many companies are working to rid their algorithms of these biases.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>While most states are trying to regulate the use of the technology,<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a> Massachusetts, Michigan, and New York are considering temporary bans on the use of facial recognition technology by law enforcement until they can be certain that their citizens\u2019 privacy can be protected.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> Entire states banning the technology is obviously concerning to companies developing facial recognition software. They argue that, if regulated properly, the benefits far outweigh the risks.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a> \u00a0Federal legislation would certainly help to reduce the risks to the public and give these companies consistency and clarity on what products they are permitted to sell. Amazon has grown tired of waiting for Congress draft laws themselves and has reportedly begun writing its own facial recognition laws to pitch to federal lawmakers.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a>\u00a0 It has not released any information on these laws yet, but they will likely mirror the guidelines for legislation it offered in a blog post from earlier this year.<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a> Some of its recommendations in that blog post include requiring that the facial recognition system be ninety nine percent confident in a match for law enforcement investigations, providing written notice in areas where real-time facial recognition is in use, and developing standardized testing methodologies for measuring accuracy.<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a>\u00a0 Although Amazon has been praised by some for taking an initiative to improve the industry, others have concerns about one of the wealthiest corporations in the world drafting laws that will govern its own product.<a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a> \u00a0Whether you like Amazon drafting the laws or not, Congress must do something soon.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a><em>See<\/em> Jason Tashea, <em>As Facial Recognition Software Becomes Ubiquitous, Some Governments Slam on the Brakes,<\/em> Aba Journal (Sept. 24, 2019), http:\/\/www.abajournal.com\/web\/article\/facial-recog-bans.<\/p>\n<p><a href=\"#_ftnref2\" name=\"_ftn2\">[2]<\/a> <em>See id.<\/em><\/p>\n<p><a href=\"#_ftnref3\" name=\"_ftn3\">[3]<\/a> <em>See <\/em>Clare Garvie, Alvaro Bedoya &amp; Jonathan Frankle, <em>The Perpetual Line-Up,<\/em> Geo.
