Can the Law Catch Up?"},"content":{"rendered":"<p>By: Brandon Larrabee<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-7522 aligncenter\" src=\"https:\/\/jolt.richmond.edu\/files\/2018\/12\/Larrabee-2-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" \/><\/p>\n<p style=\"text-align: justify;\">Scientist He Jiankui might have gotten more than he bargained for after claiming he had created the first gene-edited humans: the Chinese government is now saying his actions broke the law.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn1\" name=\"_ftnref1\">[1]<\/a> Xu Nanping, vice minister for science and technology, said He\u2019s breakthrough &#8212; if it is confirmed, of course &#8212; \u201cblatantly violated China\u2019s relevant laws and regulations.\u201d<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p style=\"text-align: justify;\">The truth is that many nations are still struggling to figure out their policies on gene editing &#8212; and those that have policies are dealing with debates over whether those regulations should be more or less stringent.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn3\" name=\"_ftnref3\">[3]<\/a> For example, stringent laws in Canada &#8212; where editing \u201cgerm line\u201d cells could land someone a 10-year prison term &#8212; have come under fire from researchers.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn4\" name=\"_ftnref4\">[4]<\/a> A similar \u201ccrime\u201d could bring a 15-year sentence in Australia.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/p>\n<p style=\"text-align: justify;\">The United States, for its part, doesn\u2019t ban germ line editing per se.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn6\" name=\"_ftnref6\">[6]<\/a> Other countries have a policy somewhere in between. The United Kingdom, for instance, allows use of gene editing techniques as long as the embryos are not maintained for more than 14 days and are not implanted.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/p>\n<p style=\"text-align: justify;\">The developments could also force countries and other entities to confront arguments that have so far been largely theoretical, or at least on the very verges of science. For example, the prospect of gene-edited babies is likely to bring new focus to a recent ruling by the European Court of Justice on genetic modifications.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn8\" name=\"_ftnref8\">[8]<\/a> The court seemed to place techniques like CRISPR &#8212; the method used for human gene editing &#8212; under the European Union\u2019s regulations for genetically-modified organisms.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn9\" name=\"_ftnref9\">[9]<\/a> (Whether humans with edited genomes would have to be labeled somehow is unclear.)<\/p>\n<p style=\"text-align: justify;\">Elsewhere, laws are not as clear as they could be.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn10\" name=\"_ftnref10\">[10]<\/a> France, for example, bans anything that would \u201cundermine the integrity of the human species,\u201d but critics say the definition of \u201ccrimes against the human species\u201d is vague.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p style=\"text-align: justify;\">How effective any of these laws will be in the future is questionable, for two reasons. The first is that technology is changing so rapidly that laws simply might not be able to catch up.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn12\" name=\"_ftnref12\">[12]<\/a> The other problem is the possibility of \u201creproductive tourism,\u201d where wealthy families will travel anywhere that they can get a gene-editing procedure done.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn13\" name=\"_ftnref13\">[13]<\/a> That has led to questions about whether the problem needs to be tackled internationally.<a href=\"applewebdata:\/\/2CDF2122-8F1C-4B12-BA56-108BFB30E324#_ftn14\" name=\"_ftnref14\">[14]<\/a><\/p>\n<p style=\"text-align: justify;\">The problem, of course, is that international law generally moves even more slowly than domestic law.
