{"id":7486,"date":"2018-11-19T12:00:47","date_gmt":"2018-11-19T17:00:47","guid":{"rendered":"https:\/\/jolt.richmond.edu\/?p=7486"},"modified":"2019-03-08T19:51:58","modified_gmt":"2019-03-09T00:51:58","slug":"crispr-cas-9-patent-war-comes-to-close-for-now","status":"publish","type":"post","link":"https:\/\/blog.richmond.edu\/jolt\/2018\/11\/19\/crispr-cas-9-patent-war-comes-to-close-for-now\/","title":{"rendered":"CRISPR\/Cas-9 Patent War Comes to Close, For Now"},"content":{"rendered":"<p>By:\u00a0Sarah Alberstein<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-7487 aligncenter\" src=\"https:\/\/jolt.richmond.edu\/files\/2018\/11\/Sarah-2-300x168.png\" alt=\"\" width=\"300\" height=\"168\" \/><\/p>\n<p style=\"text-align: justify;\">UC Berkeley and MIT\u2019s Broad Institute have been battling over the patent to coveted CRISPR\/Cas-9 technology since 2012.<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn1\" name=\"_ftnref1\">[1]<\/a> CRISPR\/Cas-9 technology can be used to \u201csilence mutated organismal DNA, replace it with correct sequences, or both in conjunction\u2026[and] to sustain and lengthen the lifespan of\u2026bacterial cultures by protecting them from viral attack\u2026minimiz[ing] hassle and time spent re-growing cultures following a viral attack while maximizing efficiency for the researcher.\u201d<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn2\" name=\"_ftnref2\">[2]<\/a> What\u2019s more, unlike previous gene-editing technologies, CRISPR-Cas-9 \u201cmakes it possible to observe specific effects of a particular gene and thus allows for more precise data collection and observation\u201d while minimizing down-stream mutation.<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn3\" name=\"_ftnref3\">[3]<\/a> The implications of CRISPR\/Cas-9 are immense. For example, CRISPR\/Cas-9 has the potential to cure previously incurable diseases, like Alzheimer\u2019s and HIV, remove malaria from mosquitos, develop new drugs, alter livestock and agricultural crops, and develop new cancer treatments.<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn4\" name=\"_ftnref4\">[4]<\/a> It is no surprise that there would be controversy over who owns and controls the patent for this powerful technology.<\/p>\n<p style=\"text-align: justify;\">As of April 2018, the U.S. Patent and Trademark Office \u201chad issues 60 CRISPR-related patents to nearly 20 different organizations.\u201d<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn5\" name=\"_ftnref5\">[5]<\/a> However, there is one patent in particular which has been hotly contested \u2013 the patent that covers the use of CRISPR-Case9 to edit DNA in mammals.<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn6\" name=\"_ftnref6\">[6]<\/a> In May 2012, Berkeley filed a patent application for the use of CRISPR\/Cas-9 to \u201cedit genes in various types of cells.\u201d<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn7\" name=\"_ftnref7\">[7]<\/a> In December 2012, the Broad Institute and MIT filed a patent for the use of CRISPR\/Cas-9 to \u201cmodify DNA in eukaryotic cells.\u201d<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn8\" name=\"_ftnref8\">[8]<\/a> In April 2014, the USPTO granted the Broad Institute their December 2012 patent, which UC Berkeley subsequently contested as being too similar to UC Berkeley\u2019s May 2012 patent.<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn9\" name=\"_ftnref9\">[9]<\/a> In February 2017, the USPTO ruled in favor of the Broad Institute stating that the Broad Institute\u2019s December 2012 patent was not an obvious extension of UC Berkeley\u2019s May 2012 patent.<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn10\" name=\"_ftnref10\">[10]<\/a> In June 2018, the USPTO granted a patent to UC Berkley for the use of CRISPR\/Cas-9 to edit single-stranded RNA, and a patent for the use of CRISPR\/Cas-9 to edit genome regions of 10 to 15 nucleotides long.<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p style=\"text-align: justify;\">Finally, in September 2018, the US Court of Appeals for the Federal Circuit upheld the USPTO\u2019s ruling in favor of the Broad Institute\u2019s December 2012 patent for the use of CRISPR\/Cas-9 in editing eukaryotic cells.<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn12\" name=\"_ftnref12\">[12]<\/a> As a result, the Broad Institute has the rights to \u201ccommercialize products developed by using the CRISPR\/Cas-9 system to make targeted changes to the genomes of eukaryotes \u2013 a group of organisms that includes plants and animals\u2026cover[ing] a wide swath of potential CRISPR\/Cas-9 products.\u201d<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn13\" name=\"_ftnref13\">[13]<\/a> While the results of this case seem to indicate that the patent war over CRISPR\/Cas-9 technologies is coming to a close, there is still some movement within the industry. UC Berkeley could appeal the US Court of Appeals decision to the US Supreme Court which, given the zeal each institution has exhibited during this patent dispute, is not outside the realm of possibility.<a href=\"applewebdata:\/\/A13BC05E-E761-409E-8E90-72A217FF6C2D#_ftn14\" name=\"_ftnref14\">[14]<\/a> Moreover, the CRISPR\/Cas-9 technology landscape is ever-evolving.
