{"id":2625,"date":"2015-03-05T17:41:34","date_gmt":"2015-03-05T17:41:34","guid":{"rendered":"http:\/\/jolt.richmond.edu\/?p=2625"},"modified":"2019-03-08T19:52:24","modified_gmt":"2019-03-09T00:52:24","slug":"blog-the-likely-impacts-of-patenting-a-clean-energy-economy","status":"publish","type":"post","link":"https:\/\/blog.richmond.edu\/jolt\/2015\/03\/05\/blog-the-likely-impacts-of-patenting-a-clean-energy-economy\/","title":{"rendered":"Blog: The Likely Impacts of Patenting a Clean Energy Economy"},"content":{"rendered":"<p>By: Andrew Landrum, Associate Technical &amp; Public Relations\u00a0Editor<\/p>\n<p>The clean energy industry has soared to new heights in recent years.\u00a0 Clean energy investment and development have continued to surge despite oil price fluctuations<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>, and the Energy Industry Association predicts clean energy production capacity will increase by sixty percent between now and 2016.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a>\u00a0 New data shows that, concomitant to this expansion, clean energy patents have reached an industry high.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a>\u00a0 &#8220;Everyone is scrambling to stake out their territory and nobody knows how valuable the technology will be,\u201d says C. Erik Hawes of Morgan Lewis &amp; Bockius.\u00a0 \u201cThose factors . . . have . . . [created] a gold rush on renewable patents[.]\u201d<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a>\u00a0 The skyrocketing rate of new clean energy patents will likely produce mixed results for market participants.<\/p>\n<p>Patents serve a valuable role in development.\u00a0 They introduce new innovations to the public by requiring the dissemination of technical knowledge in exchange for exclusive rights over the technology.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a>\u00a0 Small businesses then have access to the patent\u2019s information, which drastically reduces industry learning curves and encourages building upon successful ideas.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a>\u00a0 The Coalition for Innovation Development &amp; Employment Alliance (IDEA) is a pro-business group launched by the United States Chamber of Commerce, which fights hard for powerful protections to the United States\u2019 patent system. \u00a0The patent system, IDEA says, is vital to a growing cleantech industry, which will result in the creation of millions of American jobs.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/p>\n<p>However, the increase in clean energy patents may also burden companies with increased costs in litigation.\u00a0 Clean energy companies used to be able to avoid costly patent infringement battles.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a>\u00a0 But, with the increase in clean energy revenues, that may soon change.<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a>\u00a0 Patent infringement suits are notoriously costly and recent clean energy cases have resulted in up to $170 million in damages.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a>\u00a0 Surveys show average infringement litigation costs generally run parties over $5 million, and generally last for two to four years.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a>\u00a0 The actual impact on cleantech patent litigation will be decided once the margin of growth stabilizes and the true value of clean energy is realized.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a><\/p>\n<p>But, the market is still growing and there are few big players in the renewable market.
