Elonis<\/em><span style=\"color: #444444; line-height: 1.7;\">&#8212; that involves rap lyrics posted to Facebook that were prosecuted as &#8220;true threats.&#8221; \u00a0I&#8217;ve just written <\/span><span style=\"color: #008000;\"><a style=\"line-height: 1.7;\" href=\"http:\/\/www.forbes.com\/sites\/realspin\/2014\/05\/24\/rap-lyrics-or-true-threats-its-time-for-the-high-court-to-decide\/\"><span style=\"color: #008000;\">this op-ed<\/span><\/a><\/span><span style=\"color: #444444; line-height: 1.7;\"> for <\/span><em style=\"line-height: 1.7;\">Forbes<\/em><span style=\"color: #444444; line-height: 1.7;\">, along with First Amendment expert <\/span><span style=\"color: #008000;\"><a style=\"line-height: 1.7;\" href=\"https:\/\/www.jou.ufl.edu\/faculty\/facultydetail.asp?id=ccalvert\"><span style=\"color: #008000;\">Clay Calvert<\/span><\/a><\/span><span style=\"color: #444444; line-height: 1.7;\"> from the University of Florida and <\/span><span style=\"color: #008000;\"><a style=\"line-height: 1.7;\" href=\"http:\/\/socialecology.uci.edu\/faculty\/ckubrin\"><span style=\"color: #008000;\">Charis Kubrin<\/span><\/a><\/span><span style=\"color: #444444; line-height: 1.7;\">, my regular partner in crime on this rap-as-evidence topic. \u00a0In it we argue that the Court should take up the case, not only because it deals with the prosecution of rap lyrics, but also because it offers an opportunity to provide much-needed guidance on &#8220;true threats&#8221; jurisprudence in the age of social media.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>As this blog makes abundantly clear, I&#8217;ve been very interested in the (mis)use of rap lyrics as evidence in trials. \u00a0As it turns out, there&#8217;s a case up for consideration by the Supreme Court&#8211;U.S. v.
